Terms of Use

These Terms govern your use of BuyHub, a service by Museum App Inc.. By creating an account or using BuyHub you accept these Terms. If you do not agree, do not use the service.
1. What BuyHub is
BuyHub is a search tool that aggregates and displays results from third-party marketplaces (eBay, Vinted, Wallapop and others) and, when you authorize it, performs actions on those marketplaces on your behalf. BuyHub is NOT the seller nor a party to the transactions: these occur directly between you and the relevant marketplace or seller. BuyHub shows no advertising.
2. Third-party marketplaces and your connection
BuyHub searches third-party platforms we do not control, each with its own terms of use and privacy policy. When you open a listing, contact a seller, buy, or link your account, you enter into a DIRECT relationship with that marketplace and that seller, to which BuyHub is not a party and which is governed by their terms.
You undertake to know and respect the terms of each marketplace you use through BuyHub, exactly as if you had reached that website on your own, and not to use BuyHub to do anything on a marketplace that the marketplace prohibits. We cannot accept those terms on your behalf, nor answer for them for you.
With the extension or the app installed, the request to the marketplace goes out FROM YOUR OWN DEVICE, using your connection, your IP address and, if you are signed in to that store, your own session: you are the one browsing, and we compose the request and organise the response. Without them, some requests are made from our servers and under our responsibility.
We do not control or warrant the accuracy, availability, prices, stock or condition of the items marketplaces display, nor the decisions they make (including access restrictions, blocks or account closures). We are not responsible for your dealings with sellers or for the transactions you carry out on those platforms. This does not limit our own liability for the operation of BuyHub.
3. Account and eligibility
You must be at least 16 years old to create an account, and provide accurate information. If your country requires a higher age to contract on your own behalf, that age applies. You are responsible for the activity on your account and for keeping your credentials confidential. You share the same account with Museum.app.
4. Plans: what is free and what needs a subscription
Without an account you can run one sample search on eBay. With a free account you can search eBay with no search limit, save searches and favourites, and keep one radar that checks at most once an hour.
Searching the other marketplaces — and searching several at once, keeping more radars or having them check more often — requires a paid subscription. The Plans page lists each plan and its price.
5. Your subscription: price, billing and cancellation
Who charges you. On the web, your subscription is sold and invoiced by Paddle.com Market Ltd, acting as merchant of record on behalf of Museum App Inc.: Paddle is who appears on your invoice and who calculates and remits taxes. If you subscribe from the iPhone or Android app, the sale is made by Apple or Google through their store. In every case, the service is provided by Museum App Inc..
Price and renewal. The price shown includes applicable taxes. The subscription renews automatically at the end of each period, at the price then in force, until you cancel.
Cancellation. You can cancel at any time. On the web, from Settings → Subscription. If you subscribed in the app, cancel from your Apple or Google Play subscription settings. Cancelling stops the next renewal: you keep the service until the end of the period you have already paid for.

6. Linked accounts and actions on your behalf (bids and purchases)
You may link marketplace accounts so BuyHub can search and act on your behalf. Linking is voluntary and revocable at any time. We never store your marketplace passwords.
When you link an account you decide what happens to its session, and you can change that at any time under “Linked accounts”. If you choose to store it with BuyHub, we encrypt it on our servers with AES-256-GCM (authenticated encryption): it is always stored encrypted, the encryption key does not live in the database, and we never store your passwords for those marketplaces. In exchange, your account works across all your devices without signing in again. If you choose “this device only”, its session never leaves your phone: the account still appears in your list, but you will have to sign in on each device. Storing it is optional and the service works without it.
We apply appropriate technical and organisational measures to protect that material: encryption at rest, access control and minimisation — we keep only what the session needs to work, and delete it when you unlink the account. Even so, no internet-connected system is completely invulnerable. To the maximum extent permitted by law, Museum App Inc. will not be liable for damages arising from unauthorised access, attacks or security failures beyond its control that occur despite those measures. This limitation neither excludes nor restricts liability that the law does not allow to be excluded — including wilful misconduct, gross negligence, personal injury and our obligations under data protection law — and does not affect your rights as a consumer. If you prefer to keep this exposure to a minimum, choose “this device only”.
Features such as last-second bidding (sniping) or buying on eBay are executed with YOUR account and under YOUR authorization, at the amount and conditions you set. You expressly authorize BuyHub to place those bids or purchases on your behalf. You are solely responsible for the bids and purchases you schedule and their outcome (including payment if you win).
IMPORTANT: automated bidding (sniping) may breach the marketplace’s own terms (for example, eBay restricts automated use of its bidding features). By enabling this feature you acknowledge and assume that risk, including possible suspension of your account on that marketplace. BuyHub is not liable for consequences arising from breaching third-party terms.
7. Acceptable use
You agree to use BuyHub lawfully and not to: (a) use it for illegal or fraudulent purposes; (b) attempt to breach the service’s security; (c) resell or redistribute the service without authorization; (d) use the service in a way that infringes third-party rights or the marketplaces’ terms.
8. Affiliate links
Some product links may include affiliate-program identifiers (such as the eBay Partner Network), for which we may receive a commission at no additional cost to you. This does not change the price you pay or bias the results we show you.
9. "As is" service and availability
BuyHub is provided "as is" and "as available". We do not warrant that the service will be uninterrupted or error-free, nor the accuracy or availability of data obtained from third parties. We may modify, suspend or discontinue features at any time.
10. Limitation of liability
To the maximum extent permitted by law, Museum App Inc. shall not be liable for indirect, incidental or consequential damages, or lost opportunities, arising from your use of the service or your transactions with third-party marketplaces or sellers.
11. Intellectual property
BuyHub’s software, brand and own content belong to Museum App Inc. or its licensors. Marketplaces’ trademarks and content belong to their respective owners and are shown for informational and search purposes.
12. Third-party trade marks
The names, trade marks and logos of the marketplaces and sellers shown on BuyHub belong to their respective owners. We display them solely to identify the source of each result and to let you recognise where an item is listed, as permitted for the referential and descriptive use of another party's trade mark.
BuyHub is NOT affiliated with, associated with, authorised by, sponsored by or endorsed by any of those marketplaces or trade mark owners, unless expressly stated otherwise on the page itself. The appearance of a trade mark on BuyHub implies no commercial relationship with its owner and no approval of BuyHub by them.
If you own a trade mark, or are its authorised representative, and believe our use of it is incorrect, write to us at contact@museum.app: we will review it promptly and, where appropriate, remove or change that use.
13. Suspension and termination
We may suspend or terminate your access if you breach these Terms. You may stop using the service and delete your account at any time from settings.
14. Changes to the Terms
We may update these Terms. We will post the current version on this page with its date; for significant changes, we will notify you. Continued use after an update constitutes acceptance.
15. Dispute resolution: individual arbitration and class action waiver (United States only)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY DECIDE YOUR CLAIMS. YOU MAY OPT OUT WITHIN 30 DAYS.
Scope. This section applies ONLY to users who reside in the United States or its territories, and does not apply in any country whose law does not permit it. If it does not apply to you, the governing law and courts section applies to you directly.
The Federal Arbitration Act governs. This section evidences a transaction involving interstate commerce, and the Federal Arbitration Act (9 U.S.C. §§ 1-16) governs its interpretation and enforcement, to the exclusion of any state arbitration statute.
Pre-arbitration notice and informal resolution (condition precedent). Before commencing arbitration, the party raising the dispute must send the other a written Notice of Dispute to contact@museum.app, signed personally, stating their name, the email address on their account, the nature and basis of the claim, and the relief sought and how it was calculated. For 60 days the parties will negotiate in good faith. If a court is asked to decide whether this step was satisfied, the arbitration and any obligation to pay arbitration fees are stayed until that is resolved. Limitation periods and provider filing deadlines are tolled from receipt of the Notice until 30 days after those 60 days end.
Individual arbitration. The arbitration will be administered by JAMS under its consumer rules (Consumer Arbitration Minimum Standards), which prevail over this section in the event of conflict; if JAMS is unavailable, by the American Arbitration Association. There will be one arbitrator, and the proceeding will be conducted by videoconference or on documents only unless you elect an in-person hearing, which will be held where you live. The award has no precedential or preclusive effect in any other proceeding. We will pay the provider's fees in excess of what it would have cost you to file the same claim in the court where you reside, and we will pay them when due.
Small claims court. Either you or we may bring an individual claim in a small claims court of competent jurisdiction instead of arbitration. This right is mutual.
Intellectual property and public injunctive relief. Either party may go to court for injunctive relief against infringement of its intellectual property rights; this right is mutual. And to the extent a claim seeks public injunctive relief, it is EXCLUDED from arbitration and from the waiver below and may be brought only in court: it will be severed and stayed while the other claims are arbitrated. Nothing in this section waives that right, and if a court holds this paragraph unenforceable, it will be severed and the remainder of this section will remain in full force.
CLASS ACTION WAIVER. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may award relief only in favour of the individual party seeking relief. If this waiver is found unenforceable as to a particular claim, that claim will be severed and brought in court, and all other claims will proceed in individual arbitration.
Coordinated filings. If 25 or more demands of a substantially similar nature are filed within 180 days by or with the assistance of the same law firm, they will be grouped into batches of no more than 100 which will proceed CONCURRENTLY, never sequentially, with each claim decided individually on its own merits. There are no test cases and no preclusive effect: no claimant's rights may be determined in a proceeding in which that claimant did not participate. All deadlines are tolled for every claimant until their demand is finally resolved. This rule applies equally to demands we file, and it does not delay any question about the validity of this section itself, which will be decided individually and promptly.
YOUR RIGHT TO OPT OUT — 30 DAYS. You may reject this section in its entirety by emailing contact@museum.app with the subject line "Arbitration Opt-Out" within 30 days of the date you first accept these Terms. Your name and the email address on your account are enough. You do not need to give a reason, and opting out will not affect your account, your subscription or the price you pay in any way. You only need to do this once.
Severability. Except as provided in the class action waiver, if any part of this section is found unenforceable, that part will be severed and the remainder enforced. The parties expressly disclaim any intention that the unenforceability of one provision should render any other unenforceable.
16. Governing law, courts and contact
If you reside in the United States. These Terms are governed by the laws of the State of Texas (United States), without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the dispute resolution section. If that section does not apply to you, the parties submit to the state and federal courts located in Travis County, Texas, without prejudice to your right to bring a claim in a small claims court.
If you reside in the European Economic Area, the United Kingdom or Switzerland. These Terms are governed by the law of your country of habitual residence in everything its consumer-protection rules do not allow to be derogated from by agreement, and by the laws of the State of Texas (United States) only as to the remainder. You may bring proceedings against us before the courts of your country of habitual residence, and we may bring proceedings against you only before those courts. Nothing in these Terms deprives you of the mandatory protection afforded by the law of your country, including your rights as a consumer, your right of withdrawal, and your right to take part in a representative action brought by a qualified entity. The arbitration and class action waiver section does NOT apply to you.
If you reside elsewhere. These Terms are governed by the laws of the State of Texas (United States), without prejudice to any mandatory consumer protection to which you are entitled under the law of your country of residence.
If any provision of these Terms is invalid or not binding on you, the rest continue to apply; the invalid provision will not be replaced by a narrower version: it simply will not apply to you, and the law will apply in its place.
